Terms of Service (Distance Sales Agreement)

This Distance Sales Agreement ("Agreement") is entered into between you ("Customer", "you") and Codezone Software ("Seller", "we", "us") governing your use of Codezone CMS services.

Article 1 - Parties

CUSTOMER:

The individual or legal entity who accepts this agreement during the subscription process.

Article 2 - Subject of the Agreement

This agreement governs the rights and obligations of the parties regarding the sale and delivery of digital subscription services for Codezone CMS, a cloud-based content management system, in accordance with the provisions of the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts.

Article 3 - Service Description

Codezone CMS provides the following digital services:

  • Cloud-based content management system access
  • Multi-workspace management capabilities
  • Content type and component creation tools
  • Media asset management
  • API access for content delivery
  • User and role management
  • AI-powered features (based on subscription tier)

Article 4 - Pricing and Payment

4.1 Subscription Fees

  • Prices are displayed on our pricing page and during checkout
  • All prices include applicable taxes
  • Subscription fees are charged at the beginning of each billing period

4.2 Payment Methods

We accept the following payment methods through our payment processor (iyzico):

  • Credit Cards (Visa, MasterCard)
  • Debit Cards

4.3 Payment Security

All payment transactions are processed securely through iyzico. We do not store your complete credit card information on our servers.

Article 5 - Service Delivery

  • Services are delivered electronically immediately upon successful payment
  • Access credentials are sent to your registered email address
  • No physical delivery is required as this is a digital service

Article 6 - Right of Withdrawal

6.1 Digital Content Exception

In accordance with Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for digital content that has been delivered with the consumer's prior approval and acknowledgment that the right of withdrawal will be lost.

6.2 Voluntary Refund Policy

Despite the legal exception, we offer a 14-day money-back guarantee for annual subscriptions. See our Delivery and Return Policy for details.

Article 7 - Customer Obligations

The Customer agrees to:

  • Provide accurate and complete registration information
  • Maintain the confidentiality of account credentials
  • Use the service in compliance with applicable laws
  • Not engage in any activity that may harm the service or other users
  • Not attempt to circumvent usage limitations or security measures

Article 8 - Seller Obligations

The Seller agrees to:

  • Provide the services as described in the subscription plan
  • Maintain reasonable service availability (target 99.9% uptime)
  • Protect customer data in accordance with our Privacy Policy
  • Provide customer support for service-related issues
  • Notify customers of material changes to the service

Article 9 - Service Modifications

We reserve the right to modify, update, or discontinue features of the service. Material changes will be communicated to customers in advance. Continued use of the service after changes constitutes acceptance.

Article 10 - Limitation of Liability

To the maximum extent permitted by law, our liability for any claims arising from this agreement shall not exceed the amount paid by you for the service in the 12 months preceding the claim.

Article 11 - Dispute Resolution

Any disputes arising from this agreement shall be resolved through the Consumer Arbitration Committees and Consumer Courts in the Republic of Turkey, in accordance with the monetary limits determined by the Ministry of Trade.

Article 12 - Governing Law

This agreement is governed by the laws of the Republic of Turkey, including but not limited to Law No. 6502 on Consumer Protection and related regulations.

Article 13 - Acceptance

By completing the subscription process and making payment, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
